Eindgebruikersovereenkomst (EULA) End-User License Agreement (EULA)

Deze Eindgebruikersovereenkomst ("EULA") regelt het gebruik van Diaz Editor (de "Software") door u (de "Gebruiker"). Door de Software te installeren, te kopiëren of te gebruiken stemt u in met deze voorwaarden.

1. Licentieverlening

Juan Diaz LLC verleent u een persoonlijke, niet-overdraagbare, niet-exclusieve licentie om de Software te installeren en te gebruiken op apparaten die u beheert, onderhevig aan:

Een geldige licentie-sleutel uitgegeven door Juan Diaz LLC, of
De ingebouwde proefperiode van 14 kalenderdagen, ingaand op het moment dat u uw e-mailadres bevestigt (zie § 2).

De licentie is gebonden aan u als persoon en mag niet worden uitgeleend, verhuurd, verkocht of overgedragen zonder voorafgaande schriftelijke toestemming van Juan Diaz LLC.

2. Proefperiode

De Software bevat een proefperiode van 14 dagen. Die gaat in op het moment dat u uw e-mailadres bevestigt, niet bij de eerste start: tot die bevestiging staat de aanvraag open en loopt er geen klok. Tijdens de proefperiode heeft u toegang tot alle functies. Na afloop is een geldige licentie-sleutel vereist; zonder geldige sleutel weigert de Software te starten. Er is geen creditcard nodig om te starten.

Om de proefperiode te starten vraagt de Software om naam, e-mailadres en telefoonnummer, en registreert zij een pseudonieme apparaat-vingerafdruk. Dat gebeurt om te voorkomen dat dezelfde proefperiode herhaald wordt; zie § 8. De proefperiode wordt op onze servers geklokt, niet op de klok van uw apparaat: het terugzetten van de systeemtijd verlengt hem niet.

3. Tier-niveaus

Alle licenties zijn levenslang: u betaalt eenmalig en de sleutel heeft geen vervaldatum. Er is geen abonnement en geen verlenging.

Een werkplek is één actieve installatie. Enterprise en Agency worden op aanvraag verkocht. Educational is uitsluitend bestemd voor onderwijs- instellingen en niet voor commercieel gebruik; Agency omvat het recht tot wederverkoop.

Let op bij het lezen van uw sleutel. In het licentiebestand staat een technische tier-naam die niet gelijk is aan de verkoopnaam hierboven: Founding heet daar basic, Licentie heet pro, en Pro heet lifetime. Het aantal werkplekken in deze tabel is bepalend, niet die naam.

Functionele verschillen tussen tiers worden in de productdocumentatie beschreven.

4. Beperkingen

U mag niet:

De Software reverse-engineeren, decompileren of disassembleren, behalve voor zover dit dwingend is toegestaan onder toepasselijk recht.
De licentie-sleutel publiceren, doorverkopen of delen met derden.
Gewijzigde versies van de Software verspreiden onder de naam "Diaz Editor" of een merknaam van Juan Diaz LLC.
Het ondertekenings-mechanisme van de licentie-sleutels omzeilen of wijzigen.

5. Eigendom

De Software is auteursrechtelijk beschermd. Eigendom blijft bij Juan Diaz LLC en haar licentiegevers. Diaz Editor bevat componenten van Pascal Editor, een open-source project gepubliceerd onder de MIT-licentie door Pascal Group Inc.; zie het bestand NOTICE voor details.

6. Updates en wijzigingen

Juan Diaz LLC kan op elk moment updates uitbrengen, voorwaarden wijzigen of de Software stopzetten. Wijzigingen aan deze EULA worden gepubliceerd op diazatlas.com en gaan in vanaf eerste gebruik van een versie waarin de wijziging is opgenomen.

7. Aansprakelijkheid

DE SOFTWARE WORDT GELEVERD "AS IS", ZONDER ENIGE GARANTIE, EXPLICIET OF IMPLICIET. IN GEEN GEVAL IS JUAN DIAZ LLC AANSPRAKELIJK VOOR ENIG DIRECT, INDIRECT, INCIDENTEEL, GEVOLG- OF SPECIAAL VERLIES, INCLUSIEF MAAR NIET BEPERKT TOT VERLIES VAN DATA, WINSTDERVING OF BEDRIJFSONDERBREKING, ZELFS ALS JUAN DIAZ LLC OP DE HOOGTE WAS GEBRACHT VAN DE MOGELIJKHEID DAARVAN.

De totale aansprakelijkheid van Juan Diaz LLC onder deze EULA is in alle gevallen beperkt tot het bedrag dat u voor de licentie heeft betaald in de 12 maanden voorafgaand aan de claim.

8. Privacy

Uw tekeningen blijven lokaal. De Software stuurt geen tekeningen, projectbestanden of geometrie naar onze servers. Wat u tekent, blijft op uw apparaat.

Voor licentie-, proef- en updatecontroles maakt de Software wél verbinding. Daarbij worden deze gegevens verstuurd:

Proefperiode aanvragen — naam, e-mailadres, telefoonnummer, optioneel bedrijfsnaam, een apparaat-vingerafdruk, uw besturingssysteem (bijvoorbeeld win32), of u marketingmail wilt ontvangen, en een gezouten hash van uw IP-adres. Uit dat IP-adres leidt onze server een landcode af; het adres zelf bewaren we niet. De proefperiode gaat pas lopen nadat u het e-mailadres bevestigt. Doel: de proefperiode klokken en herhaald gebruik met wisselende e-mailadressen tegengaan.
Licentie activeren — de licentiesleutel, de apparaat-vingerafdruk en de naam van uw computer. Die naam dient om een werkplek te kunnen aanwijzen wanneer u er één vrijgeeft. Dat doet u zelf: zit u op te veel apparaten, dan toont de Software de lijst met een knop per apparaat. Het kan ook via support. Na de activatie hercontroleert de Software de sleutel ongeveer eens per dag zolang hij draait.
Proefstatus controleren — alleen de apparaat-vingerafdruk, ongeveer twee keer per dag, om te voorkomen dat een verlopen proefperiode doorloopt wanneer de klok van het apparaat wordt teruggezet.
Automatische updates — de Software kijkt bij het starten en daarna elke vier uur of er een nieuwe versie is. Die controle gaat naar GitHub Releases, dat daarbij uw IP-adres ziet. De uitkomst ervan — versienummers, of de controle slaagde, en bij een fout de foutmelding — gaat samen met uw licentiesleutel en apparaat-vingerafdruk naar onze servers. Dit laatste kunt u uitzetten via Help → "Update-diagnostiek versturen". De controle bij GitHub blijft dan gewoon werken; alleen de melding aan ons blijft achterwege.
Verlenging van de proefperiode aanvragen — uitsluitend wanneer u daar in het venster na afloop zelf om vraagt: de apparaat-vingerafdruk en uw e-mailadres, zodat wij op het verzoek kunnen reageren.
Kaartachtergrond en adres opzoeken — twee functies die u zelf aanzet; standaard staan ze allebei uit.

Zet u in het achtergrondpaneel een kaartlaag aan, dan haalt de Software kaarttegels op bij PDOK (Kadaster, service.pdok.nl) of bij OpenStreetMap (tile.openstreetmap.org). Zij zien daarbij uw IP-adres en welk gebied u in beeld heeft.
Vraagt u op de tekenpagina een luchtfoto bij een adres op, dan gaat het adres dat u intypt als tekst naar de locatieservice van PDOK (api.pdok.nl), die er coördinaten bij zoekt.

In beide gevallen stelt de Software zich voor met alleen haar naam en versienummer. Uw besturingssysteem, de versie daarvan en uw taalinstelling gaan uitdrukkelijk niet mee; dat stuurden wij vóór 18 augustus 2026 wél, omdat het de standaardinstelling van de onderliggende techniek is. Dit verkeer loopt rechtstreeks naar die partijen en niet langs onze servers; wij ontvangen er niets van. Zet u de functie weer uit, dan stopt het.

De apparaat-vingerafdruk is een SHA-256-hash van eigenschappen van uw computer. Zonder onze administratie is die niet naar u te herleiden, maar hij is uniek en blijft gelijk: het is een pseudoniem, geen anoniem gegeven.

Een eerdere versie van deze paragraaf gaf onjuist weer wat de Software verstuurt en noemde de computernaam niet. De lijst hierboven is de juiste.

Gaat een toekomstige versie méér versturen dan de zes punten hierboven, dan vragen wij u daar eerst uitdrukkelijk toestemming voor via een opt-in-venster.

De volledige beschrijving — grondslagen, bewaartermijnen en uw rechten onder de AVG — staat in het privacybeleid.

8a. Directe levering en het wettelijk herroepingsrecht

Deze bepaling geldt UITSLUITEND voor licenties die via diazatlas.com zijn gekocht en in onze administratie zijn gemarkeerd als is_beta=true.

8a.1. De licentiesleutel en de download worden direct na betaling geleverd, vóór het einde van de wettelijke herroepingstermijn van 14 dagen. Om die reden verklaart de koper bij checkout uitdrukkelijk en in twee afzonderlijke handelingen:

Voorafgaande toestemming voor directe levering: de koper geeft uitdrukkelijke toestemming dat de digitale levering (license-key + download-bestand) onmiddellijk na betaling plaatsvindt, dus VÓÓR het einde van de wettelijke 14-dagen herroepingsperiode.
Erkenning verlies herroepingsrecht: de koper erkent dat hij hierdoor zijn 14-dagen herroepingsrecht onder Richtlijn 2011/83/EU verliest, in overeenstemming met artikel 16 sub m van die richtlijn.

8a.2. Beide verklaringen worden vastgelegd als verplichte aparte checkboxes bij checkout. De timestamps worden opgeslagen in onze administratie (Supabase + Stripe metadata) als bewijsstuk gedurende minimaal 7 jaar.

8a.3. Los van de afstandsverklaring in 8a.1 geeft Juan Diaz LLC een vrijwillige niet-goed-geld-terug-garantie van 14 dagen: een verzoek per e-mail aan juan@diazatlas.com binnen 14 dagen na aankoop wordt volledig gerestitueerd en de licentiesleutel wordt ingetrokken. Daarna geldt restitutie alleen nog in de volgende gevallen:

Juan Diaz LLC staakt het Diaz Editor product binnen 6 maanden na de beta-aankoop (volledig refund);
Het product blijkt door een aantoonbare en aan ons toe te schrijven bug niet bruikbaar voor de koper, mits gerapporteerd via een reproduceerbaar foutrapport binnen 30 dagen na aankoop (volledig refund);
Wettelijke verplichtingen die niet kunnen worden uitgesloten door de waiver van punt 8a.1.

8a.4. De koper wordt uitdrukkelijk aangeraden om eerst de gratis 14-dagen trial te downloaden en te testen vóór de beta-aankoop, om product-fit te verifiëren. Dit aanbod is openbaar en transparant gecommuniceerd op /beta en /terms.

8a.5. Reguliere licenties (Founding, Licentie, Pro, Educational, Enterprise, Agency) zijn NIET onderhevig aan deze bepaling — daarvoor geldt de standaard 14-dagen niet-goed-geld-terug-garantie.

9. Beëindiging

Bij overtreding van deze voorwaarden vervalt uw licentie automatisch en dient u alle kopieën van de Software te verwijderen. Beëindiging laat de bepalingen over Eigendom, Aansprakelijkheid en Toepasselijk recht onverlet.

10. Toepasselijk recht (wereldwijde verkoop)

Voor consumenten in de Europese Unie of Verenigd Koninkrijk: Het recht van het land van uw woonplaats is van toepassing. Dwingende consumentenrechten (zoals het 14-dagen herroepingsrecht onder Richtlijn 2011/83/EU en de AVG) gelden onverminderd elke andersluidende keuze van recht.

Voor overige klanten (B2B en niet-EU consumenten): Op deze EULA is het recht van de staat Delaware (Verenigde Staten) van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter in Delaware, USA, tenzij beide partijen schriftelijk anders overeenkomen.

This End-User License Agreement ("EULA") governs your use of Diaz Editor ("the Software"). By installing, copying, or using the Software, you agree to these terms.

Authoritative version: in case of dispute between this English text and the Dutch text at diazatlas.com/eula, the language of the consumer's country of residence prevails for EU/UK consumers; the English version prevails for all other customers.

1. License grant

Juan Diaz LLC grants you a personal, non-transferable, non-exclusive license to install and use the Software on devices you control, subject to:

A valid license key issued by Juan Diaz LLC, or
The built-in 14-day trial period, starting when you confirm your email address (see § 2).

The license is bound to you as a person and may not be lent, rented, sold, or transferred without prior written consent from Juan Diaz LLC.

2. Trial period

The Software includes a 14-day trial. It starts when you confirm your email address, not at first launch: until you confirm, the request stays open and no clock runs. During the trial you have access to all features. After expiry, a valid license key is required; without one the Software refuses to start. No credit card is needed to begin.

Starting the trial asks for your name, email address and phone number, and records a pseudonymous device fingerprint. This exists to stop the same trial being repeated; see § 8. The trial is clocked on our servers, not on your device: winding back your system time does not extend it.

3. License tiers

License keys come in six tiers, all sold as lifetime licenses (one-time fee, perpetual use, no subscription and no renewal):

A seat is one active installation.

Reading your key. The license file carries a technical tier name that differs from the sales name above: Founding is stored as basic, Licence as pro, and Pro as lifetime. The seat count in this table governs, not that name.

Functional differences are described in product documentation.

4. Restrictions

You may not:

Reverse-engineer, decompile, or disassemble the Software, except to the extent expressly permitted under applicable law.
Publish, resell, or share license keys with third parties.
Distribute modified versions of the Software under the name "Diaz Editor" or any Juan Diaz LLC trademark.
Circumvent or modify the license-key signing mechanism.

5. Ownership

The Software is protected by copyright. Ownership remains with Juan Diaz LLC and its licensors. Diaz Editor incorporates components from Pascal Editor, an open-source project published under the MIT License by Pascal Group Inc.; see the NOTICE file for details.

6. Updates and changes

Juan Diaz LLC may issue updates, modify terms, or discontinue the Software at any time. All future minor and major updates are included for free with your lifetime license. Changes to this EULA are published at diazatlas.com and take effect from first use of a version that includes the change.

7. Limitation of liability

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. IN NO EVENT SHALL JUAN DIAZ LLC BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOST PROFITS, OR BUSINESS INTERRUPTION, EVEN IF JUAN DIAZ LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Total liability under this EULA is in any case limited to the amount you paid for the license in the 12 months preceding the claim.

8. Privacy

Your drawings stay local. The Software sends no drawings, project files, or geometry to our servers. What you draw stays on your device.

For licence, trial and update checks the Software does connect. These are the data it sends:

Requesting a trial — name, email address, phone number, optional company name, a device fingerprint, your operating system (for example win32), whether you want marketing email, and a salted hash of your IP address. Our server derives a country code from that IP address; the address itself is not stored. The trial only starts running once you confirm the email address. Purpose: clocking the trial and preventing repeat use under changing email addresses.
Activating a licence — the licence key, the device fingerprint, and your computer's name. That name exists so a seat can be identified when you release one. You do that yourself: if you are on too many devices, the Software shows the list with a button per device. Support can also do it for you. After activation the Software rechecks the key roughly once a day while it runs.
Checking trial status — the device fingerprint only, roughly twice a day, to stop an expired trial from continuing when the device clock is set back.
Automatic updates — the Software checks for a new version at launch and every four hours after that. That check goes to GitHub Releases, which sees your IP address. Its outcome — version numbers, whether the check succeeded, and the error message if it failed — is sent to our servers along with your licence key and device fingerprint. You can switch that last part off under Help → "Send update diagnostics". The check against GitHub keeps working; only the report to us stops.
Requesting a trial extension — only when you ask for one yourself in the dialog shown after expiry: the device fingerprint and your email address, so we can respond to the request.
Map background and address lookup — two features you switch on yourself; both are off by default.

Switch on a map layer in the background panel and the Software fetches map tiles from PDOK (the Dutch Kadaster, service.pdok.nl) or from OpenStreetMap (tile.openstreetmap.org). They see your IP address and which area you have in view.
Ask for an aerial photo of an address on the drawing page and the address you type is sent as text to PDOK's location service (api.pdok.nl), which looks up its coordinates.

In both cases the Software identifies itself with nothing but its name and version number. Your operating system, its version and your language setting are deliberately not sent; before 18 August 2026 they were, because that is what the underlying technology does by default. This traffic goes to those parties directly and not through our servers; we receive none of it. Switch the feature off and it stops.

The device fingerprint is a SHA-256 hash of characteristics of your computer. Without our records it cannot be traced back to you, but it is unique and stable: a pseudonym, not anonymous data.

An earlier version of this section misdescribed what the Software transmits and did not mention the computer name. The list above is the accurate one.

Full detail — legal bases, retention periods and your rights under the GDPR — is in the privacy policy.

Should a future version transmit anything beyond the six items above, you will be asked for explicit consent through an opt-in dialog first.

8a. Immediate delivery and the statutory withdrawal right

This provision applies EXCLUSIVELY to licenses purchased through diazatlas.com and marked as is_beta=true in our records.

8a.1. The licence key and download are supplied immediately on payment, before the statutory 14-day withdrawal period would end. For that reason the buyer explicitly declares at checkout, in two separate actions:

Express prior consent to immediate delivery: the buyer gives express prior consent that digital delivery (license key + download) begins immediately after payment, BEFORE the end of the statutory 14-day withdrawal period.
Acknowledgment of loss of withdrawal right: the buyer acknowledges that this means he loses his 14-day right of withdrawal under Directive 2011/83/EU, in accordance with article 16(m) of that Directive.

8a.2. Both declarations are recorded as mandatory separate checkboxes at checkout. Timestamps are stored in our records (Supabase + Stripe metadata) as evidence for at least 7 years.

8a.3. Independently of the waiver in 8a.1, Juan Diaz LLC grants a voluntary 14-day money-back guarantee: a request sent to juan@diazatlas.com within 14 days of purchase is refunded in full and the licence key is revoked. Beyond that window a refund applies only in the following cases:

Juan Diaz LLC ceases the Diaz Editor product within 6 months of the beta purchase (full refund);
The product proves unusable to the buyer due to a verified bug attributable to us, reported via a reproducible error report within 30 days of purchase (full refund);
Statutory obligations that cannot be excluded by the waiver in 8a.1.

8a.4. The buyer is expressly encouraged to first download and test the free 14-day trial before the beta purchase, to verify product fit. This offer is publicly and transparently communicated at /beta and /terms.

8a.5. Regular licenses (Founding, Licence, Pro, Educational, Enterprise, Agency) are NOT subject to this provision — the standard 14-day money-back guarantee applies to those.

9. Termination

If you violate these terms, your license terminates automatically and you must remove all copies of the Software. Termination does not affect the provisions on Ownership, Limitation of Liability, and Governing Law.

10. Governing law (worldwide sales)

For consumers in the European Union or United Kingdom: The law of your country of residence applies. Mandatory consumer protections (including the 14-day right of withdrawal under EU Directive 2011/83/EU and GDPR) apply regardless of any choice-of-law clause.

For all other customers (B2B and non-EU consumers): This EULA is governed by the laws of the State of Delaware, United States. Disputes are resolved in the courts of Delaware, USA, unless both parties mutually agree otherwise in writing.

EU consumers can find their national dispute-resolution body via https://consumer-redress.ec.europa.eu/.
